The rules for using Gizmo.

1. Who We Are

Myworkingmemory LLC ("Company," "we," "us," or "our") provides Gizmo.

The "App" means Gizmo: Track Your Time on iPhone, iPad, Mac, or Apple Vision Pro, including updates, purchases, and related functionality made available through the App.

Questions, complaints, or claims about the App should be directed to dean@myworkingmemory.ai.

2. Acceptance of Terms

Please read these Terms carefully. These Terms of Use govern your access to and use of the App, related features, purchases, support services, websites, and any content or functionality made available through the App.

By downloading, accessing, or using the App, you agree to these Terms and acknowledge that you have reviewed the Privacy Policy. If you do not agree, do not use the App.

Our Privacy Policy explains how we handle information. The Privacy Policy is incorporated by reference into these Terms, but if there is a conflict, the Privacy Policy controls for privacy and data practices.

3. Apple App Store Terms

These Terms are between you and Myworkingmemory LLC, not Apple. We, not Apple, are solely responsible for the App and its content, maintenance, support, warranties that have not been disclaimed, and claims relating to the App, except as otherwise required by law.

Apple has no obligation to provide maintenance or support for the App.

If the App fails to conform to any applicable warranty that has not been effectively disclaimed, you may notify Apple, and Apple may refund the purchase price for the App as required by Apple's applicable terms. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.

We, not Apple, are responsible for addressing claims relating to the App or your possession or use of the App, including product-liability claims, regulatory claims, and consumer-protection, privacy, or similar claims, except as otherwise required by law.

If a third party claims that the App or your possession and use of the App infringes that party's intellectual property rights, we, not Apple, are responsible for investigation, defense, settlement, and discharge of that claim, except as otherwise required by law.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

You must comply with applicable third-party terms when using the App, including terms from Apple, your wireless carrier, cloud-storage providers, websites, and any third-party apps or services you choose to use.

You represent and warrant that you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

4. License to Use the App

The App is licensed, not sold. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App on Apple-branded products that you own or control, as permitted by Apple's usage rules.

We reserve all rights not expressly granted to you.

You may use the App only for lawful, personal, non-commercial purposes unless we expressly authorize another use in writing.

You may not copy, modify, reverse engineer, decompile, disassemble, attempt to derive source code from, sell, rent, sublicense, distribute, exploit, interfere with, overload, scrape, misuse, or access the App except as allowed by these Terms, Apple usage rules, or applicable law.

5. Download, Billing, and Refunds

Gizmo has no subscriptions, trials, paywall, consumables, or in-app purchases. Apple displays the current download price, if any, before you obtain the App.

Payment, if required, is charged to your Apple Account. Apple handles App Store billing, taxes, Family Sharing, refunds, and purchase records under Apple’s terms and policies.

Company does not receive your full payment-card number from Apple and does not control Apple’s refund decisions.

Refund requests for App Store purchases should be submitted to Apple. We do not control Apple's refund decisions, although we may provide support or information where Apple's systems allow.

If Apple issues a refund, Apple may revoke access to the refunded download where applicable.

Purchases are associated with the Apple Account used for the purchase. We may not be able to locate, transfer, or modify purchases made under a different Apple Account.

If an App Store purchase screen or offer-specific term conflicts with these Terms, the more specific purchase or offer term controls for that purchase.

6. Your Content and Responsibilities

You retain any rights you have in the content you create, enter, save, complete, commit, export, or share through the App.

We do not claim ownership of your timer titles, notes, committed-time entries, or other timer content. If you choose to send content to us for support, you authorize us and our service providers to process that content only as needed to provide the requested support, comply with law, maintain business records, or protect our rights and users.

You are responsible for the content you create, enter, save, complete, commit, export, share, or rely on through the App.

You represent and warrant that you have the rights, permissions, and lawful basis needed to create, save, export, or share any content you use with the App.

When you export, email, text, upload, open, or share content from the App, you are directing the App or your device to send that content to the destination you select. We do not control third-party destinations, and their terms and privacy practices apply.

Once you share or export content, we cannot control who accesses, copies, stores, forwards, modifies, or deletes it.

7. Local Storage, Backups, and Data Loss

The App may store content locally on your device. We cannot access, recover, back up, or delete content that is stored only on your device.
