Myworkingmemory LLC

Fix My Video:
AI Enhancer/Edit Terms of Service

Effective September 16, 2026

Availability: local preview and paid cloud restoration are separate. Cloud-restoration provisions apply only if the installed App Store build displays a plan, a finite number of video-processing seconds, Apple's current price, and a cloud-restoration control. No subscription provides unlimited processing.

1. Acceptance

These Terms of Service and Supplemental End-User Terms ("Terms") are a legal agreement between you and Myworkingmemory LLC ("Company," "we," "us," or "our") for Fix My Video: AI Enhancer/Edit, related cloud processing, support, and App pages at myworkingmemory.ai (collectively, the "Services").

You accept these Terms when you affirmatively accept them, select a purchase control presented with notice that purchase signifies agreement, or use the Services after receiving legally sufficient notice. If you do not agree, do not purchase or use the Services. You consent to transact electronically.

You must have legal capacity to agree. If you use the Services for an organization, you represent that you may bind it and "you" includes that organization. A parent or legal guardian must validly agree for a minor wherever required.

2. Definitions

"App" means Fix My Video: AI Enhancer/Edit for Apple platforms.

"Cloud Restoration" means an optional paid job in which a selected video copy is temporarily sent to Company infrastructure and an artificial-intelligence processing provider to create a video result.

"Company Parties" means Company and its current and former affiliates, members, managers, officers, directors, employees, agents, contractors, licensors, service providers, successors, and assigns.

"Output" means a local preview or cloud-processed video produced at your request.

"Processing Seconds" means the finite whole-video-second allowance available for Cloud Restoration under the offer shown in the App.

"User Content" means the video, audio, filename, instructions, messages, settings, support material, and other content you choose to use with or send through the Services.

3. Product description

The App helps you make a short video easier to watch without requiring editing vocabulary. You may choose a MOV or MP4, select Natural, Low Light, or Detail, adjust strength, make a local preview of the first 12 seconds at source resolution, compare it, and export a separate copy. The App does not overwrite the source file. The local export includes the source audio track.

The built-in helper explains controls and may suggest a look. It receives only basic media metadata, current controls, and limited conversational context. It does not view the video, diagnose unseen content, authorize a purchase, upload a file, begin paid processing, or apply a change without your action.

If offered in your installed App Store build, paid Cloud Restoration temporarily sends an app-owned video copy to private Amazon Web Services ("AWS") storage and to fal - Features & Labels Inc. ("fal") for AI processing. Cloud Restoration is separate from the local preview. Local preview does not establish or guarantee Cloud Restoration quality.

4. Your content and authority

As between you and Company, you retain the rights you lawfully hold in User Content. You are responsible for it and for obtaining every ownership right, license, consent, release, privacy authorization, parental authorization, and other permission needed to select, process, download, export, share, or publish it.

You represent that your use of User Content and Output will not violate law; privacy, publicity, copyright, trademark, contractual, or other rights; a court order; a platform rule; or a duty owed to another person.

You grant Company and the providers used to fulfill your request a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, access, transform, create a technical derivative from, and otherwise process User Content solely to operate, secure, troubleshoot, and provide the Services, comply with law, and enforce these Terms. This content license ends when that processing and required retention end, except that operational records without the video content may remain as described in the Privacy Policy.

The Services do not publish a public gallery. Your actions outside the Services, destinations you choose, and anyone with whom you share a file or link are your responsibility.

5. Apple App Store and license terms

The App is licensed, not sold. If Company has not supplied a custom end-user license agreement through App Store Connect, Apple's Standard Licensed Application End User License Agreement governs the App license. These Terms supplement that license only to the extent validly accepted and consistent with Apple's non-waivable terms and Usage Rules.

Subject to these Terms, Apple's Usage Rules, and applicable payment terms, Company grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for lawful personal or internal business purposes on Apple-branded devices you own or control and through Family Sharing or other associated accounts only where Apple and the product configuration permit.

These Terms are between you and Company, not Apple. Company, not Apple, is responsible for the App and its content, maintenance and support, and claims concerning the App, including product-liability, legal-compliance, consumer-protection, privacy, and intellectual-property claims, except as Apple's rules provide. Apple has no obligation to furnish maintenance or support.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may provide a refund where required by its policies or law. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.

You represent that you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism and are not on a U.S. government restricted-party list. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are intended third-party beneficiaries of this section and may enforce it.

6. Subscriptions, finite allowances, billing, and refunds

The App is not an unlimited-processing service. If Cloud Restoration is offered, the App displays the available subscription, finite number of Processing Seconds, billing period, current localized price, and any trial before purchase. Apple controls the final purchase sheet. A paid transaction must be confirmed before Company authorizes paid processing.

Unless the App Store offer expressly says otherwise, Processing Seconds apply only during the subscription period for which they are issued and do not roll over. Subscription access does not guarantee that every file is compatible or that every attempt will succeed.

After the server accepts a job, it measures the selected clip duration and rounds it up to the next whole second. It reserves that number of Processing Seconds while the job runs and consumes them only when a successful result is made available. A final processing failure releases the reserved Processing Seconds. fal's provider-managed automatic retries are disabled. Company may make at most one separately controlled second attempt where server limits, available budget, and the displayed offer permit.

Automatic renewal

An auto-renewable subscription continues for successive periods unless cancelled at least 24 hours before the current period ends. Apple charges the Apple Account within 24 hours before renewal at the price Apple displays, subject to Apple's notice and consent rules for price changes. Manage or cancel in Apple Account subscription settings. Deleting the App does not cancel a subscription.

Trials

If Apple displays a free or discounted trial, Apple determines eligibility and shows the duration and renewal price before confirmation. Unless cancelled before the trial ends as Apple specifies, it converts to the displayed paid subscription.

Restore Purchases

Restore Purchases asks Apple for eligible transaction information. Restored access depends on the Apple Account signed into the App Store, Apple's current signed transaction status, the product configuration, and successful server verification. Restoration does not revive expired Processing Seconds, deleted video files, or an unavailable service.

Pending, cancelled, refunded, or revoked transactions

A pending transaction creates no cloud allowance until Apple confirms it. A cancelled transaction creates no purchase. Apple administers payment credentials, taxes, cancellation, and refund requests under its rules. A refund, chargeback, or revocation may end unused access when verified. Nothing here limits a non-waivable refund or consumer right.

Company does not receive your full payment-card number, bank-account number, or Apple Account password.

7. Cloud job limits and operation

Initial Cloud Restoration limits are an MP4 or MOV input no longer than 30 seconds, no more than 30 frames per second or 200 MB, no larger than 1920 by 1080, and a maximum 1080p output. The App and server identify the limits that apply before upload. Company may reduce, expand, or otherwise change limits prospectively to protect quality, security, provider compatibility, and unit economics.

The server independently verifies the Apple transaction, pseudonymous app-account token, allowance, file properties, quote, idempotency key, rate limits, retry ceiling, and business spending limit. Client-provided settings, prices, cost estimates, entitlement fields, or helper messages cannot authorize provider spending.

A job can be refused, delayed, cancelled, failed, or placed under review if information is missing or inconsistent; payment is pending, expired, refunded, or revoked; the file is unsupported; a limit is exceeded; the provider is unavailable; processing cost exceeds the reserved ceiling; the request appears duplicated or abusive; or law, safety, security, or platform obligations require it.

Once external processing has begun, cancellation may not stop provider work already underway. Company releases reserved Processing Seconds for a final failed job, but Apple subscription charges and refund decisions remain governed by the purchased subscription and Apple's rules.

8. Temporary storage and deletion

You must download a result promptly. Company cannot recover an expired or deleted video. The source file, local App copy, exported copies, backups, and files held by Apple or a destination you select are governed by your device, settings, and those providers.

9. Output limitations and your review

Video enhancement is probabilistic and can fail or change details. Output may add, remove, soften, sharpen, distort, invent, or misread textures, faces, skin, hair, text, objects, motion, color, timing, or other content. It may be less accurate or less attractive than the source. It is not a faithful historical reconstruction or evidence of what originally happened.

The service attempts to attach the source audio without changing the audio content, but does not guarantee compatibility, synchronization, channel layout, metadata, or preservation for every file. Watch and listen to the complete Output before relying on, deleting, publishing, or sharing anything.

Output is not professional, forensic, medical, legal, safety, identity, authenticity, or archival advice. Do not use it as the sole basis for a rights-affecting decision, evidence, identity verification, news claim, historical claim, emergency use, or preservation of an irreplaceable original.

10. Acceptable use

You may not use the Services or Output to:

Violation is a material breach. Company may reject or stop a job, preserve relevant evidence, limit access, report unlawful material where required or appropriate, and seek available legal relief.

11. Privacy and security

The Privacy Policy explains data handling and is incorporated into these Terms. You are responsible for protecting your device, Apple Account, passcode, source files, exported files, and temporary links.

No device, network, provider, storage system, model, access URL, or security measure is perfectly secure. Do not submit content whose temporary cloud processing presents an unacceptable risk to you or another person.

12. Company intellectual property and feedback

Company and its licensors own the Services, including the App, code, interface, design, documentation, brand, workflows, and Company materials. No right is granted except the limited license expressly stated. These Terms do not transfer ownership of your User Content.

You may not copy, modify, sell, lease, sublicense, publish, distribute, commercially exploit, remove notices from, or use Company materials to train, evaluate, or build a competing model, dataset, product, or service, except where non-waivable law permits.

If you send ideas, suggestions, bug reports, reviews, requests, or other feedback, you grant Company a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use and incorporate that feedback for lawful business purposes without attribution or compensation. This does not cover a customer video merely processed through the service and does not restrict an honest consumer review.

13. Third-party services

The Services depend on third parties including Apple, iOS, StoreKit, App Attest, AWS, fal, Vercel, internet carriers, device storage, file providers, and destinations you choose. Their terms and privacy practices apply to their services.

Company Parties do not control and are not responsible for third-party acts, omissions, outages, security incidents, model behavior, processing time, data practices, prices, refunds, rules, compatibility, policy changes, or discontinuation. Company may replace a provider or processing method if the material customer-facing data practice and terms remain properly disclosed.

14. Changes, suspension, and discontinuation

Company may update, modify, limit, suspend, or discontinue the Services or a feature where reasonably necessary for quality, cost control, law, safety, security, Apple requirements, provider availability, or business operations. Updates may change supported files, limits, allowances, providers, or availability. Non-waivable rights and Apple's rules continue to apply.

Company may update these Terms and will provide notice or obtain acceptance where required. Material rights-affecting changes apply prospectively to the extent required. If you do not accept updated Terms, stop using the Services and cancel any subscription through Apple.

Company may restrict or terminate service access for material breach, fraud, abuse, security risk, unlawful use, payment revocation, provider or platform requirements, or discontinuation. Deleting the App does not cancel an Apple subscription.

15. Copyright and intellectual-property notices

If you believe Company-controlled material infringes intellectual property, send a notice to the contact below. A copyright notice should include the information required by 17 U.S.C. 512: identification of the work and material, your contact details, good-faith and accuracy statements, and a physical or electronic signature.

Company may remove or restrict material and terminate repeat infringers where applicable. Because customer videos are temporary and not published in a public gallery, a complained-of processing object may already have been automatically deleted.

16. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." COMPANY PARTIES DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AUTHENTICITY, QUALITY, SECURITY, AVAILABILITY, COMPATIBILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

COMPANY PARTIES DO NOT WARRANT THAT A VIDEO WILL BE ACCEPTED, IMPROVED, RESTORED, ACCURATE, COMPLETE, OR AVAILABLE; THAT OUTPUT WILL PRESERVE EVERY DETAIL, FRAME, COLOR, FACE, WORD, MOTION, AUDIO PROPERTY, OR METADATA ITEM; THAT A JOB WILL FINISH BY A PARTICULAR TIME; OR THAT AN EXPIRED VIDEO CAN BE RECOVERED.

Some jurisdictions do not allow particular disclaimers, so some may not apply to you. Nothing limits a warranty or consumer right that cannot lawfully be excluded.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, CONTENT, BUSINESS, OPPORTUNITY, OR GOODWILL; BUSINESS INTERRUPTION; SUBSTITUTE SERVICES; OR DAMAGES ARISING FROM ALTERED, LOST, EXPIRED, DISCLOSED, INACCESSIBLE, OR INACCURATE CONTENT OR FROM THIRD-PARTY SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES, USER CONTENT, OUTPUT, THESE TERMS, OR THE PRIVACY POLICY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO APPLE FOR THE APP OR RELEVANT SUBSCRIPTION DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD $50.

These limits apply regardless of theory and even if a remedy fails of its essential purpose. They do not limit liability for fraud, gross negligence, willful misconduct, or liability or non-waivable rights that applicable law does not allow to be limited.

18. Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Company Parties from third-party claims, damages, liabilities, losses, judgments, costs, and reasonable attorneys' fees resulting from your User Content, Output, misuse, material breach, violation of law or another person's rights, fraud, or willful unauthorized conduct.

Company will give reasonable notice of a covered claim and may control its defense and settlement. You will reasonably cooperate and may not impose an admission, liability, or non-monetary obligation on a Company Party without written consent. This does not require indemnity where prohibited or to the extent a claim results from a Company Party's fraud, gross negligence, or willful misconduct.

19. Contract with the LLC

Your contract is with Myworkingmemory LLC, not an individual Company Party. Tennessee law generally does not make an LLC's members, managers, officers, employees, or agents personally liable for the LLC's obligations solely because of that status.

To the fullest extent permitted by law, you covenant not to seek personal liability from an individual Company Party for a claim arising from the Services solely because of that person's relationship with Company. This does not bar a direct claim that non-waivable law permits based on that person's own conduct. Company Parties are intended beneficiaries of this section.

20. Dispute resolution

This section applies to disputes arising from or relating to the Services, User Content, Output, purchases, communications, these Terms, the Privacy Policy, or the relationship between you and Company Parties.

20.1 Informal resolution

Before arbitration or court proceedings, each side must send an individualized written Notice of Dispute and participate in a 60-day good-faith resolution period. Send notice to dean@myworkingmemory.ai and include your name, contact information, App name, purchase platform, relevant facts, requested relief, and enough information to investigate. This does not prevent an eligible small-claims case or permitted emergency equitable relief.

20.2 Binding individual arbitration

Except for the express exceptions below, disputes will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules and, where applicable, Mass Arbitration Supplementary Rules. The Federal Arbitration Act governs. Arbitration is seated in Nashville, Davidson County, Tennessee, although a hearing may occur remotely or as applicable rules or law require.

20.3 Formation and delegation

A court decides whether an arbitration agreement was formed and issues law requires a court to decide, including enforceability of class or representative waivers where required. After formation, the arbitrator decides other questions of interpretation, scope, applicability, validity, enforceability, waiver, and arbitrability.

20.4 Individual proceedings and no class relief

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND COMPANY PARTIES MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, COORDINATED, CONSOLIDATED, MASS, REPRESENTATIVE, OR JOINT ACTION.

An arbitrator may not conduct class, collective, consolidated, representative, private-attorney-general, or joint merits arbitration or join more than one person's claims without every affected party's written consent. Administrative coordination under AAA Mass Arbitration Supplementary Rules does not create class or consolidated merits arbitration.

20.5 Mass arbitration

If coordinated counsel or entities file enough similar demands to trigger AAA's current Mass Arbitration Supplementary Rules, those rules govern administration, fees, batching, sequencing, mediation, and case management. Each claim remains individual.

20.6 Jury-trial waiver

FOR A CLAIM THAT IS NOT ARBITRATED, YOU AND COMPANY PARTIES KNOWINGLY AND VOLUNTARILY WAIVE TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

20.7 Arbitration opt-out

You may opt out by emailing dean@myworkingmemory.ai within 30 days after first accepting these Terms. Include your name, App name, purchase platform, and a clear opt-out statement. Opting out does not affect other Terms, including an independently enforceable class-action or jury-trial waiver.

20.8 Small claims and provisional relief

Either side may bring an individual claim in small-claims court if it qualifies and remains there. Either side may seek temporary or preliminary equitable relief to preserve the status quo pending arbitration. Company Parties may also seek relief concerning intellectual property, unauthorized access, cybersecurity, scraping, reverse engineering, confidentiality, data misuse, fraud, or threats to operations. This does not waive arbitration of damages or other claims.

20.9 Fees, confidentiality, and severability

AAA's applicable fee schedules govern, subject to law. Each side will keep arbitration content and results confidential except as needed to enforce an award, comply with law, or obtain professional advice.

If the class, collective, or representative waiver is unenforceable as to a claim, that claim proceeds in court and the rest of this section continues for other claims. If another part is unenforceable, it is severed and the remainder continues.

21. Governing law and forum

Tennessee law governs these Terms and disputes, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs arbitration. For a matter not subject to arbitration, you and Company submit to the exclusive jurisdiction of state and federal courts in Davidson County, Tennessee, and waive venue objections. Nothing removes non-waivable consumer protections of your place of residence.

22. One-year limitation period

To the maximum extent permitted by law, a claim arising from or relating to the Services, User Content, Output, purchases, these Terms, or the Privacy Policy must be filed within one year after it accrues or is permanently barred. A longer non-waivable limitation period controls where required.

23. Export, sanctions, and government users

You must comply with U.S. export-control, sanctions, and denied-party laws and other applicable trade laws. The App is commercial computer software; U.S. government users receive only the rights described in these Terms consistent with FAR 12.212 and DFARS 227.7202.

24. General terms

These Terms and the Privacy Policy are the entire agreement about the Services and supersede prior understandings on that subject. If a provision is unenforceable, it is modified to the minimum extent necessary or severed and the rest remains, subject to Section 20. A failure to enforce is not a waiver.

You may not assign these Terms without Company's written consent. Company may assign them to an affiliate, successor, acquirer, service operator, or in connection with financing, reorganization, merger, or asset sale. Company is not liable for delay or failure caused by events beyond reasonable control. Nothing creates a partnership, employment, fiduciary, agency, or joint-venture relationship.

Sections that by nature should survive do survive, including content responsibility and license where needed, intellectual property, feedback, disclaimers, liability, indemnification, LLC protection, disputes, governing law, limitation period, and general terms.
