Terms of Service
By using Cue, you agree to these terms. Cue is a small iPhone game offered by Myworkingmemory LLC ("we", "us"). The terms are short on purpose.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Cue on Apple-branded devices you own or control, subject to these terms and the Apple Licensed Application End User License Agreement, which applies whenever you download Cue from the App Store. If those terms conflict with ours, the Apple terms control for App Store distribution.
2. In-app purchase
Cue is free to download. After three full sessions of play, continued play requires a one-time in-app purchase of $1.99 ("Unlock"). The Unlock is a non-consumable purchase that unlocks unlimited sessions on any device signed in to the same Apple ID. The Unlock is not a subscription and does not auto-renew. All payments are processed by Apple. Refund requests must be directed to Apple under their standard refund policy.
3. Restrictions
You agree not to:
(a) reverse engineer, decompile, or disassemble Cue except where iOS or applicable law
expressly permits;
(b) sell, rent, lease, or sublicense Cue;
(c) remove or alter any copyright or attribution notices;
(d) use Cue to violate any law or any third party's rights.
4. What Cue measures, and what it does not
Cue is a small game built on the Posner spatial-cueing task, a well-known paradigm used in attention research. It measures and reports your performance on this specific task — your reaction time, accuracy, and the validity effect between cued and miscued trials. Cue makes no claim to improve attention, focus, memory, intelligence, or any cognitive ability in everyday life. Any score you receive describes your performance on the task itself and should not be interpreted as a measurement of, or training for, broader cognitive abilities. Cue is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.
5. Updates
We may release updates through the App Store. We are not obligated to provide updates, support, or maintain Cue indefinitely.
6. Disclaimer of warranties
Cue is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. You use Cue at your own risk.
7. Limitation of liability
To the maximum extent permitted by law, Myworkingmemory LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or business, arising out of or related to your use of Cue, even if advised of the possibility of such damages. Our total cumulative liability shall not exceed the amount you paid for the app.
8. Termination
This license terminates automatically if you breach these terms. On termination, you must stop using Cue and delete it from your devices.
9. Governing law
These terms are governed by the laws of the State of [YOUR STATE], United States, without regard to its conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in [YOUR STATE].
10. Changes
We may revise these terms. Material changes will be reflected by updating the Effective date above. Continued use of Cue after a change constitutes acceptance of the revised terms.
