1. Who We Are

Myworkingmemory LLC ("Company," "we," "us," or "our") operates Lister: Write & Draft Notes for iPhone, iPad, Mac, and Apple Vision Pro (the "App"). This Privacy Policy explains what information the App collects, how we use it, how we share it, and what choices you have.

2. Short Version

Lister is a free-download list app with optional App Store purchases.

Lister writes your lists to your device and uses your Apple iCloud account to sync them between your devices. If you choose Premium shared lists, the lists you select, member access, and activity are stored through Apple CloudKit and made available to people you invite. Company does not operate a Lister account system and does not receive list text through product analytics.

Smart Assist reads a photo you select with Apple's on-device Vision framework or creates a deterministic checklist on your device. The selected image, prompt, and result are not sent to Company's analytics service. Optional operational analytics can be turned off in the App.

3. Product and Privacy Posture

The App is designed as follows:

  • Apple App Store distribution;
  • free download with optional App Store purchases;
  • no Company account;
  • local storage and Apple iCloud Documents sync;
  • optional CloudKit shared lists while Premium is active;
  • on-device Smart Assist processing;
  • no third-party advertising SDK or cross-app tracking at the effective date;
  • no health, medical, mental-health, biometric, financial, legal, employment, housing, education, or safety-critical features;
  • no contacts, camera, microphone, or precise-location access requested during ordinary use; and
  • limited operational analytics, which can be turned off in the App.

Different App features or data practices may require different disclosures, controls, or consents as required by applicable law or platform rules.

4. Information Stored on Your Device and in Apple iCloud

During ordinary use, the following information is stored locally on your device and may be included in Lister's iCloud Documents sync file:

  • list titles;
  • list items;
  • item notes, links, quantities, dates, reminders, stages, completion, and flags;
  • images you attach to list items;
  • list type, folders, view settings, ordering, revisions, and deleted-item recovery records;
  • local preferences; and
  • the analytics on/off preference.

The App writes a local copy first. Apple processes the iCloud copy under your Apple Account and Apple's terms. Company does not receive your iCloud credentials and does not receive your list titles, list-item text, attached images, or Smart Assist input or output through product analytics.

Premium shared lists use Apple CloudKit. A shared-list record may include the selected list's content, timestamps, invitation and member status, member display names supplied by Apple, and up to 50 recent activity entries. People you invite can view or edit the shared list according to the access shown in the App.

If you choose to share, print, message, copy, screenshot, back up, sync, or export list content using Apple, iOS, iPadOS, macOS, visionOS, device, printer, cloud, messaging, or third-party features, that action is controlled by you and by the services you choose.

5. Product Analytics

Unless you turn analytics off in the App, the App may send limited operational analytics to Company's telemetry endpoint.

Analytics may include:

  • event name;
  • event timestamp;
  • a one-way SHA-256 hash of the App's random installation identifier;
  • a one-way SHA-256 hash of the random session identifier;
  • platform: iOS, macOS, or visionOS;
  • app version;
  • build number;
  • purchase model;
  • the App Store product identifier for a purchase-funnel event; and
  • limited allowlisted properties such as list type, numeric counts, analytics setting, restore result, or the accepted legal-document version, hash, and locale.

The server rejects unknown event names, unknown properties, unexpected fields, invalid identifiers, oversized requests, and excessive event volume. Current event names are:

  • app launch;
  • list created;
  • list archived or unarchived;
  • item added;
  • item completed;
  • item deleted;
  • list deleted;
  • store viewed;
  • purchase started, completed, pending, cancelled, failed, or unavailable;
  • purchase restore result;
  • successful Smart Assist scan or plan result count;
  • legal terms accepted; and
  • analytics preference changed.

The server receives the random installation and session identifiers only to validate and immediately hash them before database storage. Analytics do not include list titles, list-item text, attached images, Smart Assist photos, prompts, recognized text, or generated checklist text.

6. Network and Hosting Data

When the App contacts Company's telemetry endpoint or when you visit Company's website, Company's hosting, security, and infrastructure providers may process routine technical information, such as:

  • IP address;
  • request time;
  • endpoint path;
  • app or browser technical data;
  • basic logs;
  • security signals; and
  • error or performance information.

This information is used to operate, secure, debug, maintain, and improve Company systems.

7. Support Communications

If you contact Company for support, Company may receive:

  • your email address;
  • your name if you provide it;
  • the contents of your message;
  • attachments you choose to send;
  • device or app details you choose to provide; and
  • other information needed to respond.

Do not send sensitive list content unless you want Company to review it for support purposes.

Company uses support communications to respond to you, troubleshoot, maintain business records, enforce Terms, protect Company Parties, and comply with law.

8. Apple and App Store Data

Apple processes App Store purchases, refunds, taxes, chargebacks, Family Sharing, ratings, reviews, crash information, diagnostics, and App Store analytics under Apple's own terms and privacy policies.

Company may receive aggregated sales, performance, crash, or analytics information from Apple. Company does not receive your full payment-card number from Apple.

9. Information Company Does Not Receive Through Ordinary App Use

Company does not receive the following through product analytics:

  • Company account usernames or passwords;
  • payment-card numbers;
  • list titles, list-item text, notes, links, or attached images;
  • contacts;
  • precise location;
  • photos or videos selected for Smart Assist;
  • camera data;
  • microphone data;
  • biometric identifiers or biometric information;
  • health or medical data;
  • structured sensitive personal information requested by the App as a required field or data category;
  • advertising identifiers for cross-app tracking;
  • SMS or phone-call data;
  • Smart Assist prompts, recognized text, or generated checklist text; or
  • data for sale to data brokers.

Apple may process synced and shared-list content through iCloud Documents and CloudKit under your Apple Account and Apple's terms. That Apple processing is separate from Company's product analytics.

10. How We Use Information

Company uses information to:

  • provide, operate, maintain, secure, and improve the App;
  • understand whether users use the free app, view the store, begin or complete a purchase, use purchased tools, and continue using the App;
  • troubleshoot bugs, crashes, device issues, and performance issues;
  • respond to support, legal, safety, and privacy requests;
  • enforce Terms and protect Company Parties, users, platforms, and payment systems;
  • prevent fraud, abuse, scraping, unauthorized access, and security incidents;
  • comply with law, app-store rules, payment rules, and legal process; and
  • make business decisions about maintenance, pricing, marketing, and product direction.

11. Analytics Choice

You can turn optional product analytics on or off in the App.

When analytics are off, the App does not send optional product analytics from that device. Turning analytics off sends one preference event before the setting takes effect. Turning analytics on sends one preference event after the setting takes effect.

12. How We Share Information

Company may disclose information to:

  • service providers and processors that host, support, secure, analyze, debug, or maintain the App and Company systems;
  • Apple and platform providers for App Store distribution, purchases, refunds, app review, crash reporting, analytics, fraud prevention, and account administration;
  • professional advisors, insurers, auditors, and business operations providers;
  • authorities, courts, regulators, or litigants where legally required or reasonably necessary;
  • acquirers, successors, financing parties, or transaction parties in connection with a merger, acquisition, financing, restructuring, or asset sale; and
  • other parties with your direction or consent.

Company does not sell personal information and does not share personal information for cross-context behavioral advertising.

13. Advertising and Tracking

The App does not include third-party advertising SDKs, cross-app tracking, or behavioral advertising.

The App does not request Apple's App Tracking Transparency permission because it is not designed to track you across apps and websites owned by other companies.

Different advertising, tracking, sale, share, or behavioral-advertising practices may require updated disclosures, controls, or consents as required by applicable law or platform rules.

14. Retention

Your local list content remains on your device until you edit it, delete it, delete the App, erase the device, or handle it through your own backup or device settings. Synced and shared copies remain subject to your iCloud and CloudKit activity, Apple's systems, and the App's revision and recovery controls.

Company deletes Lister product-analytics events from its telemetry database after 90 days through an automated daily cleanup. Hosting providers may temporarily process routine network and security logs under their own operational retention. Company retains support communications, transaction records received from Apple, consent records, business records, and legal records as reasonably necessary for support, tax, accounting, legal compliance, dispute resolution, fraud prevention, App Store compliance, and business operations.

Company may retain deidentified, aggregated, or non-personal information.

15. Security

Company uses reasonable administrative, technical, and organizational measures designed to protect information appropriate for the App's size and data posture. No system is perfectly secure.

You are responsible for your device, passcode, Apple account, backups, cloud settings, shared links, exported files, printed lists, messages, and network security.

16. Children

The App is not directed to children under 13. Company does not knowingly collect personal information from children under 13.

If you believe a child under 13 provided personal information to Company, contact Company so the request can be reviewed under applicable law.

17. State Privacy Rights

Depending on where you live and which laws apply, you may have rights to access, correct, delete, port, restrict, appeal, or opt out of certain processing.

Some U.S. state privacy laws apply only above certain revenue, volume, or data-sale thresholds. Company may not be covered by every state privacy law at all times. Company handles privacy requests as required by applicable law.

Send privacy requests to dean@myworkingmemory.ai. Company may need to verify your identity before responding. Company handles non-discrimination obligations as required by applicable law.

Because list content is stored on your device and through your Apple iCloud account, Company generally cannot access, correct, export, or delete that content for you. You control local lists in the App and iCloud data through your Apple Account and Apple's controls.

18. California Privacy Notes

The App does not sell personal information, share personal information for cross-context behavioral advertising, or use third-party ad tracking.

Because the App is not a browser-based service, browser "Do Not Track" signals do not change App behavior. Different web tracking, advertising, sale, or share practices may require updated disclosures, controls, or consents as required by applicable law or platform rules.

19. Consumer Health, Biometric, and Sensitive Data

The App does not request or require consumer health data, biometric identifiers, biometric information, precise location, children's data, financial account data, government identifiers, or other sensitive data as structured fields or required data categories through ordinary use.

Because list titles and list items are free-text content you choose to enter, you may choose to enter sensitive information even though the App does not request it. That free-text content is stored locally and may sync through your Apple iCloud account; Company does not receive it through product analytics.

Do not use the App as a medical, mental-health, therapeutic, biometric, emergency, legal, financial, or safety-critical tool.

Different health, wellness, biometric, face, voice, precise-location, AI, SMS, or other regulated features may require updated notices, consents, retention schedules, or deletion rights as required by applicable law or platform rules.

20. International Use

The App is operated from the United States and is intended for distribution in the United States.

If you use the App from outside the United States, you understand that information may be processed in the United States or other locations where service providers operate.

21. Changes

Company may update this Privacy Policy from time to time. The updated version is identified by an updated effective date.

Material data-practice changes are handled as required by applicable law and platform rules.
